Seismocon Application and Website Terms and Privacy Notice

This notice applies when a person creates or uses a Seismocon account through the website or mobile application, registers a Monitoring Unit, purchases or upgrades a Service, or is presented with this notice. It is a concise notice only. The complete Seismocon Master Terms of Service Version 2.4 at https://www.seismocon.com/terms-conditions and Seismocon Privacy Policy Version 1.2 at https://www.seismocon.com/privacy-policy control and are incorporated when applicable. A signed enterprise or government agreement controls a direct conflict as stated in the Master Terms.

1. Free and Paid Service Levels

The website and mobile application may provide mirrored access to the same account under Free and Paid Service Levels.

Free Service Level: may include account access, educational and public seismic information, selected maps, assessments, reports, notifications, and promotions.
Paid Service Level: may include Monitoring Unit registration and management, subscriptions, telemetry, alerts, diagnostics, storage, structural assessments, downloadable reports, and premium analytics.

Features may vary by platform, country, subscription, connected device, and release. Planned features are not guaranteed. Before purchase or upgrade, the user must receive the applicable price, billing period, trial, automatic-renewal, cancellation, refund, hardware, warranty, data-plan, and feature terms. Cancellation may return an account to an available Free Service Level.

2. Important Service limitations

Seismocon Services and Outputs are automated informational and decision-support tools. They are not professional engineering, structural, geotechnical, emergency-response, public-safety, inspection, certification, code-compliance, insurance, financial, medical, or legal advice. They do not determine or authorize entry, evacuation, occupancy, use, or reoccupancy. They do not replace physical inspection, official emergency instructions, independent professional judgment, or action by an Authority Having Jurisdiction. The Services are not a substitute for 911 or emergency dispatch.

3. Information and privacy summary

Depending on the Service, Seismocon may collect account and contact information; transactions and subscriptions; property, building-taxonomy, location, Monitoring Unit, sensor, telemetry, diagnostic, technical, usage, communication, marketing, and preference information; public and third-party records; and information derived through automated processing.

Seismocon may use this information to provide, secure, support, analyze, and improve the Services; generate reports and alerts; market Seismocon products and subscriptions; personalize offers from insurers, emergency-preparedness suppliers, and other relevant providers; and develop structural, property, environmental, and seismic datasets, analytics, benchmarks, and planning tools.

Subject to applicable law, contract, notice, consent, and user choices, Seismocon may disclose, license, share, or sell certain information. Aggregated or deidentified information is the preferred form for commercial data products. Seismocon will not sell or use for targeted advertising account passwords, payment-card security information, private communications, passive-infrared possible-presence indications, audio recordings, real-time individual location, exact internal sensor placement, or government-restricted or critical-infrastructure security information.

4. Privacy choices

U.S. users may opt out of sale, sharing, and targeted advertising where applicable by using Do Not Sell or Share My Personal Information, a legally recognized universal opt-out signal where required, or the methods in the Privacy Policy. Users may separately opt out of commercial disclosure of identifiable property or structural information where offered.

In the European Economic Area, United Kingdom, Switzerland, and other jurisdictions requiring consent, qualifying personalized advertising and commercial disclosure of identifiable structural information will remain disabled until the required consent is obtained. Consent may be withdrawn as easily as it was given. Marketing choices do not stop essential account, security, transaction, monitoring, or service communications.

Account-level choices will apply across the website and mobile application where technically feasible and legally required. Browser-, device-, operating-system-, app-store-, or advertising-identifier settings may require separate action.

5. Required registration acceptance

The following checkbox must be unchecked by default and required before account creation or first authenticated use:

[ ] I agree to the Seismocon Master Terms of Service Version 2.4 and acknowledge that I have read the Seismocon Privacy Policy Version 1.2.

“Master Terms of Service Version 2.4” and “Privacy Policy Version 1.2” must be separate, working links. Acknowledging the Privacy Policy is not consent to optional advertising or data-commercialization processing. No prechecked box, passive acceptance, or combined optional consent may be used.

6. Optional privacy choices

Where the applicable law requires consent, each relevant choice must use a separate unchecked control:

[ ] I consent to personalized advertising and offers based on my profile and use of the Services.
[ ] I consent to Seismocon sharing or licensing identifiable property and structural information as described in the Privacy Policy.
[ ] I consent to receive marketing emails, text messages, or calls.

The interface must identify which communications are selected, provide any legally required carrier disclosures, and permit later withdrawal. In jurisdictions using an opt-out model, the interface must provide the corresponding opt-out controls instead of treating continued use as consent.

7. Paid Service Level acceptance

Immediately before purchase or upgrade, display a clear order summary and require an unchecked acceptance control:

[ ] I agree to the Paid Service Level terms shown above and authorize the stated recurring charges until canceled.

The order summary must show the product or plan, total price, taxes and shipping when known, billing frequency, trial end date, renewal terms, cancellation method, refund rules, included features, hardware and warranty terms, and any cellular or other data-plan terms. Obtain renewed acceptance of the Master Terms or acknowledgment of the Privacy Policy when required because the controlling versions changed.

8. Acceptance and choice records

The backend must retain an auditable record of the user or account identifier, Report or transaction identifier where applicable, platform, application version, country or jurisdiction presented, exact document titles and versions, exact wording presented, timestamp, affirmative action, optional consent and opt-out selections, later withdrawals or changes, and any applicable universal opt-out signal. An older or incomplete record must not overwrite a newer choice.

9. Contact and controls

Privacy controls and request methods must be accessible from both the website and mobile application without requiring a purchase. Users may contact legal@seismocon.com with the subject line Privacy Request or Opt-Out Request.
