By using the Seismocon Earthquake Report and submitting your information, you agree to the Terms and Conditions outlined in this document, along with our Privacy Policy and Cookie Policy.

By agreeing and selecting "YES" next to the question, "Do you accept the Terms and Conditions?" during your submission, you confirm your acceptance of all legal agreements. These agreements include this Terms and Conditions document, as well as any updates made at the discretion of Seismocon Systems, Inc. ("Seismocon", "we", "us", "our"). You are also agreeing to be bound by the Terms of Use, Crowdfunding Terms, and Privacy Policy available on the Seismocon website.

2. Purpose of the Earthquake Report

The Seismocon Earthquake Report provides an estimate of how a building in a specific geographic area may respond to seismic forces, similar to those experienced near your location. The report utilizes data from trusted sources, such as the United States Geological Survey (USGS), to assess seismic risks.

However, please note:

  • Seismocon does not inspect the physical condition of your building. We do not have knowledge of the structural components or any external factors affecting your structure (e.g., seismic activity, wind, water, ground conditions, construction, repairs, etc.).

  • The report is based on the taxonomy data you provide, and Seismocon does not verify the accuracy of the responses you submit. External variables that may affect the building’s structural integrity are not considered, and these factors could result in an inaccurate risk assessment. It is the user's responsibility to understand that Seismocon is not liable for the accuracy of the data or resulting assessments.
     

3. The Report and Its Limitations

The Earthquake Report is intended for personal use only and is not to be used for commercial or financial purposes. The report serves as an indicative methodology to help users understand potential impacts on the structure at the specified service address.

  • The calculations in the report are based on data from the Global Earthquake Model Foundation (GEM) and USGS sources.

  • The building’s risk classification is determined using GEM and USGS risk tables.

  • The risk zone of the structure is derived from US governmental databases.

Important: The report provides an approximation and should not be considered an exact assessment of the structure’s seismic risk. It is strongly recommended that you consult a professional structural engineer for a comprehensive evaluation of your building’s safety.

4. Report Results - Disclaimer

The Seismocon Earthquake Report calculates the risk assessment based on the following factors:

  1. The building type defined in your taxonomy.

  2. Data from a governmental strong motion sensor, or a Seismocon monitoring unit, if installed.

  3. Geographic risk zone determination based on third-party databases.

  4. Adjustments made according to the details provided in your taxonomy.

  5. Data tables provided by GEM and USGS, using input data from the above sources.

Unless a Seismocon monitoring unit is installed and connected to Seismocon servers, the sensor values are not directly extracted from your building, and therefore, the results are considered an approximation. It is strongly recommended that you consult a professional engineer to assess your building’s structural integrity after reviewing the report.

In the case that a Seismocon monitoring unit is installed at the service location, please note that the sensor data may be affected by various factors that could cause inaccuracies. Seismocon is not responsible for any corrupted or inaccurate data uploaded to our servers, which may lead to an erroneous report.

5. Seismocon’s Liability

Seismocon Systems shall not be held liable for any damages resulting from natural disasters, including bodily injury, death, financial loss, or property damage caused by earthquakes, landslides, hurricanes, volcanic events, explosions, or any other incidents that may compromise the integrity of the structure (service address*).

You agree to hold Seismocon Systems harmless from any liability arising from the information presented in the Earthquake Report, including claims related to injury, death, or property damage. You acknowledge that the report serves as an indicator and should not be relied upon as an absolute tool for determining the safety or integrity of the structure.

6. Your Responsibilities

As a backer or user of the Seismocon system, you are responsible for ensuring the safety and structural integrity of your building or property. This includes verifying the accuracy of the information provided in the Seismocon report and consulting with qualified professionals or experts to determine what actions, if any, are needed to maintain or improve the structural integrity of the building you have provided data for (via the taxonomy) or where you have installed a Seismocon monitoring unit.

It is important to understand that the report serves as a tool to help assess potential risks, but it does not replace the need for expert evaluation, especially when it comes to making critical decisions about the safety of the structure.

7. Data Submission and Use

Any data you submit to Seismocon Systems will be used for the creation of reports and may be shared with third-party database providers or for research and educational purposes. By submitting your data, you consent to the collection, storage, and use of your data for these purposes, as outlined in this Privacy Policy. Seismocon will make every reasonable effort to protect your data. However, in the event of a data breach, you agree to release Seismocon from any liability for financial loss or data loss resulting from such an incident.

When you provide your house address, email, and mobile phone number, Seismocon uses this information to monitor seismic activity around your location and send you alerts. These alerts may be delivered via text messages (SMS) or email.

Please note that product development may face delays, and there is a possibility that the project could fail. In such cases, rewards may not be fulfilled, and contributed funds are non-refundable.

Refunds and Cancellations

  • No Cancellations: Once you’ve backed the Seismocon campaign, you cannot cancel your contribution. This is part of the crowdfunding nature, where your financial support helps bring the project to life.

Shipping Information
