Family and Friends Access Terms

These Family and Friends Access Terms govern invitations to access selected Seismocon property information through a separate user account. They explain who may grant access, what an invited user may do, how access can end, and the limitations that apply to shared reports and alerts.
1. Parties and applicable agreements
These Terms are between Seismocon Systems, Inc. (Seismocon, we, us, or our) and each person who grants or accepts access. An Inviting User is an account holder authorized to manage sharing for a property. An Invited User is a person who accepts an invitation through their own account. A Shared Property is the property identified in the invitation. Shared Information is the information made available under the permissions shown to the users.
These Terms supplement the applicable Seismocon Master Terms of Service, Privacy Policy, Application and Website Terms and Privacy Notice, and Report Terms, Conditions and Limitations. Each applicable document must be accessible before acceptance. These Terms control the specific invitation and access matters addressed here; the Master Terms govern other service matters. The Privacy Policy governs personal information processing. A signed enterprise or government agreement controls any express conflict as provided in the Master Terms. Mandatory rights under applicable law remain protected.
2. Separate accounts and individual acceptance
An Invited User must use their own Seismocon account and personally complete the required acceptance before access is granted. The Inviting User does not accept terms or provide optional privacy consent on another adult’s behalf. Creating an account or accepting general terms alone does not establish acceptance of these Terms unless these Terms were expressly presented and accepted in that action.
Eligibility requirements in the Master Terms apply. Any access by a minor must comply with those requirements and applicable law. Users must protect their own credentials and must not share the Inviting User’s password, recovery codes, or authentication credentials.
3. Authority to invite and disclose information
The Inviting User confirms that they are authorized to grant the selected access and have the rights, permissions, notices, and lawful basis needed to disclose the Shared Information. Adding a property to an account does not establish ownership or authority. The Inviting User must not disclose information subject to another person’s rights, confidentiality obligations, or security restrictions without the necessary authority.
Before sending an invitation, the Inviting User must review the intended recipient, Shared Property, information categories, and permissions displayed. An invitation authorizes only that specified sharing; it does not give access to unrelated properties or the entire account.
4. Access permissions and information visibility
The invitation and access settings define the scope of access. Depending on enabled features and the permissions displayed, Shared Information may include a property address and location, building details, reports, selected monitoring data, alerts, and relevant account-holder contact information. Only categories identified in the sharing summary may be disclosed through this feature.
An invitation does not grant permission to edit property information, manage Monitoring Units, change subscriptions, make purchases, invite others, or administer the account unless the relevant permission is expressly displayed and granted. Permissions must not expand silently. A later expansion must be shown to and authorized by the Inviting User and, where required, acknowledged or accepted by the Invited User.
Account passwords, recovery credentials, payment-card security information, unrelated private communications, and information about other properties are outside the sharing authorization. Sensitive presence, audio, detailed sensor-placement, or restricted infrastructure information must not be included unless an expressly approved feature, appropriate disclosure, authority, and any required separate consent permit it.
5. Responsibilities of invited users
The Invited User may use Shared Information only within the permissions granted and for legitimate property-related information and decision-support purposes. They must protect nonpublic information, avoid unauthorized access, and promptly report suspected account compromise or unauthorized disclosure to Seismocon and the Inviting User.
The Invited User must not sell or commercially exploit Shared Information, misleadingly alter reports, remove limitations or notices, or redistribute nonpublic property information without lawful authority. Complete and unmodified reports may be shared only as permitted by the Master Terms and Report Terms and with any necessary authority over the information disclosed. If editing is expressly permitted, the Invited User must provide information accurately, completely, and to the best of their knowledge, and identify uncertainty where the service allows.
6. Reports alerts and structural limitations
Shared reports, monitoring data, modeled risks, probabilities, colors, and alerts are automated informational and decision-support outputs. They are not physical inspections, professional engineering evaluations, safety certifications, official ATC-20 assessments, or determinations of actual damage. They do not determine or authorize entry, evacuation, use, occupancy, or reoccupancy.
Follow emergency officials and appropriately licensed professionals. Seismocon is not a substitute for emergency services and does not guarantee event detection, alert delivery, response time, or action by any person. Acceptance of an invitation does not appoint the Invited User as an emergency responder, property manager, guardian, or responsible professional.
The applicable Report Terms, Conditions and Limitations govern every report. Any separately required report acceptance or authorization must be completed before the relevant report action. Accepting these Access Terms does not automatically satisfy a separate report acceptance requirement. Report warnings, source attribution, and the original applicable terms and versions must remain attached or accessible when a report is shared.

7. Changing and ending access
The Inviting User may reduce or revoke access through the available access-management controls. The Invited User may decline an invitation or leave a Shared Property through the available controls. If a control is unavailable, either user may contact legal@seismocon.com for assistance. Seismocon may suspend or revoke access for unauthorized sharing, security risks, misuse, legal requirements, or other grounds stated in the Master Terms.
Revocation ends future access through the service once applied. It cannot recall information already viewed, downloaded, printed, or lawfully sent outside the service. After access ends, the Invited User must stop accessing the property through Seismocon and must delete or return nonpublic copies if lawfully requested, except where retention is required or permitted by law. Confidentiality and permitted-use restrictions continue for retained copies. Neither user may bypass revoked access.
Invitations must be associated with the intended recipient’s authenticated account. An invitation link alone does not authorize access by another person. Seismocon may cancel pending invitations or require identity verification where reasonably necessary to protect the property or account.
8. Privacy and separate optional choices
Seismocon processes invitation contact details, account identifiers, permissions, access events, and acceptance records to provide, secure, support, and administer sharing, as described in the Privacy Policy. The shared data categories and relevant identity or contact details must be disclosed in the invitation and sharing summaries.
Authorizing Family and Friends access or accepting these Terms does not authorize unrelated marketing, personalized advertising, sale or licensing of identifiable property information, or separate commercial or research disclosures. Those activities remain subject to the Privacy Policy, applicable law, controlling agreements, and separate consent or opt-out controls. Each user retains their own privacy choices and applicable rights; one user cannot waive another person’s rights.
9. Service terms liability and disputes
The Master Terms provisions concerning service availability, intellectual property, prohibited conduct, warranties, liability limitations, suspension, termination, governing law, and dispute resolution apply to this feature, subject to controlling signed agreements and mandatory law. These Access Terms do not create a new liability cap, indemnity, or arbitration agreement or restart an existing arbitration opt-out period. Nothing here excludes responsibility or remedies that cannot lawfully be excluded.
10. Changes records and contact
Seismocon will preserve the applicable document version and acceptance record. Material changes will receive legally sufficient notice and renewed affirmative acceptance when required or appropriate under the governing agreements and applicable law. A new publication alone does not replace required acceptance. Historical records will not be rewritten to show acceptance of a newer version.
